This /might/ send you down the wrong path but there was a post awhile
back on the Ubuntu Forums that stated a BCM43xx user had problems
using WPA_Supplicant with AP_Scan = 1. To test this you can either
bring up wpa_supplicant manually or modify
/src/nm-device-802-11-wireless.c and change the line:
const char * ap_scan = "AP_SCAN 1";
to:
const char * ap_scan = "AP_SCAN 2";
This is based off a single post I saw so it may not help you...

i think the problem is "freq=0 MHz"
