I don't read the GPL as saying it is. If it is then there are many programs
which violate this part.

The particular one for OpenSSL doesn't mesh with the GPL but it has been
pointed out also that some libraries like Netscape's version are GPL'd. I
think OpenSSL just gets dragged into the argument because it's the most common
variant that I know of.
