Another oddity, I am running under CYGWIN when this fails; I tried this 
at home (linux) last night and couldn't get it to fail. Maybe I am missing 
something or this is a compiler bug.
Attached is a file you can try to verify this with:
xmllint --valid --noout vbug.xml

  fails on my local compile of 2.4.20, works with 2.4.19, doesn't seems
platform specific (it really should not).
