I second Jamie on the pathbar-to-right-of-the-pane issue. With the
pathbar aligned with the icon view they look more related. With the
pathbar fully to the left, it does not look like something related to
the icon view. - Not to me atleast :D

So to me it is primarily a usability concern for newbies. I am not sure
that they will realise what the pathbar's doing if it sits to the
left...
