Because that seems to be the way it works at the moment - the application causing the file to be opened is responsible for adding it to the list. Eg: If you double click on a file in Nautilus, Nautilus adds the file to the list, not the application. Thus if Epiphany causes the file to be opened, then it should add the file to the list.
