Not all wellformedness errors should be treated equally harsh, IMO.
An illegal character is not on the same level as eg. unbalanced tags,
or missing closing quotes.
Maybe, it's even worse.
And in the end you will see dacuments labeled as ISO-8859-1 featuring
w*nd*ws-1252 characters...
