Yes, definitely, although the proposed PulseAudio configuration would allow
them to spy without first exploiting a local vulnerability to gain root
privileges.

There needs to be a cleaner solution to the persistent problems with making
PulseAudio cooperate well with both desktop environments and concurrent
console sessions. It shouldn't be necessary for users to set up complex
work-arounds.
