As far as I understood, that's exactly their point.

Well, type "lsmod | grep -v nvidia", and you'll see that the api to load
modules is really widely used, and is definitely not been done on
purpose for the nvidia driver.

If they begin allowing such things in the kernel, everyone will come
with a useless free driver that will just load a proprietary driver with
the real stuff, and ask for its inclusion!
