Clearly indicating to users whether a dialog is modal or not -
preventing interaction with other windows or not is a rather
significant difference in behavior, so not using the exact same
presentation for both cases (and letting users find out by trial and
error whether they can still interact with the parent window or not)
makes a lot of sense.

I don't see how your goal wasn't already achieved by the parent window
not taking focus if the user tries to click it or one of its widgets.

What are some examples of confusion that was caused by a modal dialog
that could move without taking the parent with it?

Whether particular dialogs like "Print" and "Save" should be 
modal is
a rather different question really ...
