Whether this trademark would create a liability for a movie or TV
production company that shows Audacity in use on screen is another
question.  I would say "definitely not" because a movie or TV program
could not reasonably be mistaken for a computer program for editing
sound files, nor could its appearance in use on screen be mistaken for a
claim that the production company is the sole bona fide manufacturer the
said computer program.  IP attorneys and insurance providers might say
otherwise, on the basis that it may be cost effective for movie or TV
producers to pay extortionists up front rather than risk having to
defend their rights in Court.

USPTO ( http://tess2.uspto.gov/ ) says an attempt to trademark "GIMP"
was made years ago by a person selling legitimate products and services
related to the GIMP, based on then-present use of the mark in commerce,
but the application was abandoned.
