  Well, I can't reproduce this with the latest version 
paphio:~/XSLT -> xsltproc tst.xsl /dev/null
/dev/null:1: parser error : Document is empty

/dev/null:1: parser error : Start tag expected, '<' not found
 
^
unable to parse /dev/null
paphio:~/XSLT -> /usr/bin/xsltproc tst.xsl /dev/null
