I feel your frustration at times, but ultimately guidelines are just
that; they're not requirements.
The release team can always veto the inclusion of any app that they
don't think has made enough of an effort to follow them, but to be
honest it's kind of hard to argue for that measure on the basis of
what (in this case) was/is basically a single violation, when you
could point the finger at other apps with a much bigger rap sheet if
you enforced the guidelines to the letter.
