One thing to keep in mind is that Fluendo's MP3 codec source code is BSD

If there are no patent related problems with using lame in a particular
region, the same would likely be true of Fluendo's codec.  So in those
regions, the "is it free software?" test won't help you pick between them.

For the rest of the world, we are in the position of not being able to
distribute either as free software.
